Definition: Disability Equality Duty

Disability Equality Duty is law which mainly deals with the behavior towards disabled people. The Disability Equality Duty is covered under Equality Duty Act, which also covers other duties such as Age Equality Duty, Race Equality Duty etc. Equality Duty is a duty mainly on public bodies and any other bodies which carry out public functions. It makes sure that the public bodies look at the needs of all individuals equally.

The main objectives of Disability Equality duty are:

1. To eliminate unlawful discrimination which is prohibited by the disability discrimination act.

2. To advance equality of opportunity between disabled people and non-disabled people.

3. To eliminate harassment related to the disability of disabled people.

4. To encourage participation in public life by the disabled people.

5. To foster good relationship between disabled people and non-disabled people.

6. To encourage positive attitudes towards the disabled people.


The disability equality duty explicitly recognizes that the needs of disabled people are different from those of non-disabled people. Therefore, while making policies the public bodies should be more careful and take in to account the needs of disabled people. This can also mean making necessary adjustment to the policies or treating them better than non-disabled people.


Under the Equality duty, the publicly funded education providers should not discriminate between disabled people and non-disabled people. They should be treated equally in all aspects covering admissions, access to facilities, fee structure, provision of education etc. Employers also have duty not to discriminate them and treat them equally all the aspects covering recruitment, salary structure, bonus and benefits, promotions and transfers, dismissal and retirement etc.
